Petition for the designation of successor to the leasehold interest in public lands held by intestate decedent. A family settlement agreement had been reached with respect to those lands. The Ponape State Court, YOSTER CARL, Associate Justice, gave effect to the family settlement agreement.

Intestacy - Succession - Family Settlement Agreements

Where the family of a deceased intestate enters into a settlement agreement with regard to succession to leasehold interest in land held by the intestate the Court will give effect to the settlement agreement.

A hearing on the petition for the designation of the successor to the leasehold interest of the intestate was held on June 18,1984, at which time the petitioner, Alecia Germinaro, testified.

She indicated that her mother who was the original lessee died intestate on or about December 31, 1970, and that a settle-

ment had been reached within the family with regard to the three land parcels situated in Kolonia Town. She further testified that during the family settlement it was agreed that petitioner be registered on Lease Parcel No. 008-A-11, Henry Germinaro be registered on Lease Parcel No. 008-A-12 and Andrew Germinaro on Lease Parcel No. 008-A-13.

Accordingly, Alecia Germinaro is designated the successor in interest to Parcel 008-A-11, Henry Germinaro as successor in interest to Parcel 008-A-12, and Andrew Germinaro to Parcel 008A-13.

The offices of the Ponape Land Commission and the Public lands Authority are instructed to insert necessary changes to manifest the names of the three designated successors in interest.
