     §1301.  Advertising of harmful products.

     (a)  No manufacturer, retailer, distributor of tobacco products or other person shall advertise or promote by billboard, radio, television, public broadcast, handout, device or otherwise for commercial purposes:

     (1)  cigarettes, cigars, pipe tobacco, chewing tobacco, snuff or other tobacco products;

     (2)  beer, wine, liquor or other intoxicating beverages; or

     (3)  narcotic drugs as defined in section 1003(d) of this title.

     (b)  Notwithstanding the prohibitions of subsection (a) of this section, nothing herein shall prohibit a commercial vendor from advertising prices of legal products by hand-drafted signs; PROVIDED, however, that such signs are inside of the vendor's premises and not visible to the public from outside of the vendor's premises.

     (c)  Any person who violates the provisions of this section shall be guilty of a misdemeanor, and upon conviction thereof shall be fined not more than $5,000 per offense, or imprisoned not more than 30 days per offense, or both.

     §1302.  Providing harmful products to minors.

     (a)  No manufacturer, retailer, distributor of tobacco products or other person shall sell, give or otherwise provide or distribute cigarettes, cigars, pipe tobacco, chewing tobacco, snuff or other tobacco products to a person 17 years of age or younger.

     (b)  To ensure compliance with section 1301 and section 1302 subsection (a), random, unannounced inspections will be conducted periodically by the Chief of Police, or his designee(s), of retail or other establishments where tobacco products, intoxicating beverages and narcotic drugs are manufactured, sold or distributed.

     (c)  Any person who violates the provisions of this section shall be guilty of a misdemeanor, and upon conviction thereof shall be fined not more than $5,000.00 per offense, or imprisoned not more than 30 days per offense, or both.

     §1303.  Posting signs.

     (a)  Signs shall be prominently posted in all retail or other establishments where tobacco products, intoxicating beverages or narcotic drugs are sold or distributed, on which are printed the text of section 1302, subsections (a) and (c) of this title.  The signs shall be printed in the language predominantly spoken in the area where the establishment is located and in English, in letters designed to be easily read, at least one-half inch high.

     (b)  Any person who violates the provisions of this section shall be guilty of a misdemeanor, and upon conviction thereof shall be fined not more than $500.00 per offense, and be required to comply with the requirements of this section immediately.

required for all decisions requiring a vote. The Board may adopt bylaws for its own organization and operation. (6) Members of the Board shall be compensated at the rates established by the Government Officers’ Salary Act, Title 9 Subchapter I, as amended or superseded, when actually performing functions of the Board at the direction of the Chairman, except that those members who are Pohnpei Government employees shall instead be granted administrative leave from their regular duties while performing functions of the Board. All members shall also receive travel expenses and per diem at Pohnpei Government rates when those amounts would be payable to Pohnpei Government employees in the same circumstances. (7) The Office of Economic Affairs and the Office of the Attorney General shall offer technical and legal assistance to the Board in the performance of its duties. The Governor shall provide clerical and administrative assistance as requested by the Board.
