ORDER


     The presiding judge on this matter has completed the trial and has issued the judgment in favor of the plaintff, however, there was no specific award issued. A hearing on the damages is currently set for January 13, 1997 and the court may continue said hearing for the following reasons:

     1. The current presiding judge is disqualifying himself from any further proceedings due to recent preferential treatments by one of the parties to the presiding judge and an immediate family member which may affect the outcome of the scheduled hearing on damages.

     2. The Associate Justice is now assigned to take up the matter until the case is disposed of.

     3. The presiding judge disqualifies himself pursuant to Canon 3 E(1) of the Model Code of Judicial Conduct which states in
part:

     "A judge shall disqualify himself or herself in a proceeding in which the judge's impartiality might reasonably be questioned, ..."
